Terms of Service.

Effective October 17, 2026 · Last updated October 17, 2026
Important. By creating an Income Engine account, or by using any part of our service, you agree to these Terms. Read them carefully — Section 3 covers investment-risk disclosures that specifically apply to covered-call strategies.

1Who we are and what this is

Income Engine ("Income Engine", "we", "us", or "our") is a software service operated by Joe Cabe, Summerland, California. These Terms of Service ("Terms") govern your access to and use of the Income Engine website at myincomeengine.com and any related software, APIs, or communications we provide (collectively, the "Service").

The Service is a software tool that analyzes a user-provided stock portfolio and identifies positions where a covered-call strategy may generate income. It presents options-market pricing, suggests specific trades, tracks the user's decisions, and reports outcomes. The Service is informational software only.

By creating an account, accessing the Service, or clicking "I agree" (or any similar affirmation), you ("you" or "user") accept and agree to be bound by these Terms. If you do not agree, do not use the Service.

2Not investment advice

Important — read in full

Income Engine is not an investment adviser, broker-dealer, financial planner, or fiduciary of any kind. We are not registered with the U.S. Securities and Exchange Commission, FINRA, any state securities regulator, or any other financial-services authority. Nothing in the Service constitutes investment, legal, tax, or financial advice.

The trade suggestions, rankings, estimates, and other output generated by the Service are informational only. We do not know your overall financial situation, risk tolerance, time horizon, or tax position, and we do not take them into account. Any decision to buy, sell, or hold a security — including executing a covered-call trade suggested by the Service — is solely your own.

Before executing any trade based on information from the Service, you should consider consulting a licensed investment adviser or financial professional who can evaluate your individual circumstances.

3Options and covered-call risk disclosures

Options involve risk and are not suitable for every investor. Before trading options, you must receive and read the Options Clearing Corporation's "Characteristics and Risks of Standardized Options" document, available from your broker and at theocc.com.

Specific to covered calls

Past performance

Any historical, hypothetical, or example figures shown in the Service (including on marketing pages, in your Record, and in illustrative examples) do not predict future results. Market conditions, implied volatility, and your specific positions change constantly. A strategy that generated income last month may generate less, none, or a loss in a future month.

No guaranteed income

Phrases like "monthly income," "could earn," or similar language throughout the Service describe potential outcomes based on current options-market pricing. We do not guarantee any specific income, return, yield, or outcome.

4Eligibility and account

To create an account you must be at least 18 years old and a resident of the United States. The Service is intended for self-directed investors operating their own brokerage accounts and is not available to minors, outside the United States, or on behalf of someone else without their explicit authorization.

You are responsible for keeping your account credentials secure. Do not share your password. Notify us promptly at joe@myincomeengine.com if you believe your account has been compromised. We are not liable for losses resulting from unauthorized access caused by your failure to secure your credentials.

You agree to provide accurate information when creating your account and to keep it current. You are responsible for the accuracy of the position data (tickers, share counts, cost basis) you provide. The Service's output is only as accurate as the input you provide.

5Acceptable use

You agree not to:

We reserve the right to suspend or terminate any account that we reasonably believe has violated these restrictions.

6Pricing, subscription, and cancellation

Income Engine is currently in private beta and is free during the beta period. When the beta ends and we transition to a paid tier, we will give you advance notice of at least 30 days and preferred pricing for beta users. (This matches the promise on our homepage; the Service will not switch to a paid tier before you have had 30 days' notice.)

Once a paid tier is in effect, subscriptions are billed in advance on a recurring basis (monthly or annually, at your option). You may cancel from your account page at any time; cancellation takes effect at the end of the current billing period, and you will retain access until that period ends. We do not provide refunds for partial periods except where required by law.

We may change pricing at any time. If we increase the price of your subscription, we will give you advance notice before the change applies to your next renewal; you may cancel to avoid the new price.

7Your data and your Record

You retain full ownership of your positions, trade decisions, and Record. We do not sell, rent, or share your data with third parties for marketing purposes.

You may export your Record (the history of decisions you've made through the Service) as a CSV file from the Record page at any time while your account is active. On cancellation, you should export your Record before closing your account; we may delete inactive data per our Privacy Policy.

Our handling of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8Intellectual property

The Income Engine software, website, trademarks, logo, visual design, written content, and all underlying algorithms are the exclusive property of Joe Cabe. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal use only. We retain all rights not expressly granted.

Feedback you provide about the Service (bug reports, feature suggestions, comments) may be used by us without obligation to you.

9Third-party services and market data

The Service relies on third-party providers for market data, hosting, email, SMS, and other infrastructure. These include Tradier (options market data), Supabase (database), Render (hosting), Resend (email), Twilio (SMS), Anthropic (document processing), Cloudflare (DNS and email routing), and Plausible (privacy-friendly analytics). The specific providers may change; the current list is maintained in our Privacy Policy.

Market data provided through the Service is sourced from Tradier. Options quotes are delivered via the OPRA consolidated feed with vendor-stated latency of a few seconds during market hours; delivery can be slower under heavy load. Underlying equity quotes shown alongside the options can be delayed up to 15 minutes on some Tradier plans. Outside market hours, quotes are frozen at the most recent close. The analyzer and recommendation views stamp each result with the quote time taken (the analyzed_at timestamp, surfaced as "as of HH:MM" on each pick). You should always verify current prices in your broker's own app before placing a trade. We are not responsible for data errors, latency, or outages originating from third-party providers.

10Disclaimers and warranties

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR TIMELY. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

11Limitation of liability

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL INCOME ENGINE, JOE CABE, OR ANY AFFILIATE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT RETURNS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

12Indemnification

You agree to indemnify, defend, and hold harmless Income Engine and Joe Cabe from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any applicable law or the rights of any third party, or (iv) any trade you execute, including trades based on suggestions provided by the Service.

13Changes to the service and these Terms

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may update these Terms periodically. Material changes will be announced on the website and, where appropriate, by email to the address on your account. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service.

14Termination

You may terminate your account at any time from the account page. We may suspend or terminate your access at any time for violation of these Terms, suspected fraud or security risk, or any other reason we deem appropriate in our sole discretion. Sections 2, 3, 7, 8, 10, 11, 12, and 15 survive termination.

15Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Santa Barbara County, California, and you consent to the personal jurisdiction of those courts.

You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
